When Palm Beach County homeowners visited Carman Law Firm's Boca Raton office, the homeowner explained to Attorney Deborah Carman, that one year prior to the bank attorney filing the foreclosure action they had contacted the bank, SunTrust Mortgage, Inc., and requested modification assistance as the wife was unemployed and they were at risk of default.
Like every homeowner seeking assistance, the homeowners request was met with hours of telephone runaround, misleading and inconsistent information, lost correspondence and extensive delay, yet the homeowners continued to provide the bank, SunTrust Mortgage Inc. with all of the documentation and financial information they had requested.
Months later the homeowners were served with a Summons and Complaint. Six months later, while the homeowners had already began the Home Affordable Modification Program process and received the Home Affordable Trial Modification agreement; along with a promise from the bank's representative that ALL foreclosure action would stop the bank accelerated its foreclosure process by prematurely filing a Motion for Summary Final Judgment. The bank further accelerated the process by scheduled a hearing on the Motion for Summary Final Judgment.
Being told that there was no need to hire an attorney, the homeowner appeared at the hearing without one, resulting in a sale date of their home being scheduled just a few months later. The homeowners felt that they were forced into the sale date and that they had no other choice but to agree. To complicate matters further, just a few weeks later the bank notified the homeowners that their modification was denied. It was at this point the homeowners finally realized they had been misled and were now faced with losing their home. They immediately sought a foreclosure defense attorney.
The homeowners counsel, foreclosure defense attorney Deborah A. Carman, immediately filed a Motion to Vacate the Judgment and Strike the Sale Date.
Before our motion could even be heard Attorney Deborah A. Carman was able to negotiate with SunTrust, and their attorneys, a permanent modification at a fixed-rate of 4.25% for the homeowners.
