Florida leads U.S. in foreclosures

Nevada, Arizona and California now trail Florida on the foreclosure list. 

According to a survey released Thursday, by the Washington-based Mortgage Bankers Association, Florida ranks top nationally for delinquent and foreclosed loans.

One in five Florida home loans is behind in payments or in foreclosure. One in every 155 Florida homes received a foreclosure filing during the month, 2.5 times the national average. And for the second straight month, Palm Beach County ranks first in state in foreclosure activity.

Earlier this week I read that 40% of Palm Beach County homeowners in foreclosure skip mediation and that Palm Beach County isn't alone in its struggle to contact borrowers, they have been more successful than both Broward and Miami-Dade counties. This means that more than 40% of Broward and Miami-Dade counties homeowners that are in foreclosure skip mediation. The American Arbitration Association, which handles Broward County's program, reports that as of July 1 it has been unable to reach 70 percent of eligible homeowners.

India Johnson, senior vice president for the American Arbitration Association said one problem is that people who are negotiating for a loan modification believe they don't need mediation.

"I believe that the high rate of homeowners not participating in mediation is due mostly to the banks claiming that the foreclosure is on-hold while they are under review for modification, said Boca Raton foreclosure defense attorney, Deborah A. "The banks business side and legal side simply don't connect and the sad reality is in most cases where the homeowner tries to negotiate a loan modification on their own without hiring a Florida foreclosure defense attorney the mortgage modification process forces them into foreclosure."
