Although the statewide data was incomplete, it undoubtedly indicates that Florida's Foreclosure Mediation Program has failed.
As I anticipated from its inception, the Foreclosure Mediation Program has failed, why, because the banks have little or no interest in modifying the mortgages and continue to convince Florida's homeowner's that they don't need a lawyer.
Do I really need an attorney?
YES. A recent article entitled "State details foreclosure chaos: Evidence of forgeries, bogus witnesses and illegal shortcuts" Palm Beach County Clerk and Comptroller Sharon Bock is quoted as saying; "What we got from this is the state has had the opportunity to see where the laws have been broken, and frankly, it is in large part thanks to the work of the defense attorneys."
Doing this properly is very difficult and detailed work. Why any homeowner would think that he or she could successfully handle a legal matter without an attorney highly qualified in this area of law is puzzling to me. We have clients who are themselves attorneys, yet they have come to us for help because they understand this, and realize that in order to have a chance against the "big guys" they need really qualified people to help them.
I have and continue to represent hundreds upon hundreds of Florida homeowners and see first-hand that the lenders should shoulder the primary blame for mediation failures. They show up at mediation without the appropriate paperwork, some without even a file, no authority to modify a mortgage, and little or no interest in writing down the principal amount of a loan.
The report said that additional information is needed on why homeowners don't respond to mediation invitations and why settlements aren't reached and that a major hurdle facing the program was the difficulty in contacting borrowers.
I can explain; it's the fear of losing one's home and being forced to move elsewhere.
This is why distressed homeowners are typically reluctant or afraid to communicate with their lenders. The majority of them don't realize they have rights in the foreclosure process and very few seek the advice of an experienced foreclosure defense attorney.
I am of the opinion that borrowers have no business attending mediation without proper legal representation. They are forced to divulge all of their financial information to the bank and when mediation fails, which is the majority of the time, the bank now has a road map to the borrower's finances.
If you or someone you know is facing foreclosure be sure they consult with an attorney experienced in foreclosure law.
